Terms of Service

Please read these Terms of Service carefully before engaging Hexagon Infosoft Solutions Pvt. Ltd. for software development, IT consultancy, or digital services.

1. Acceptance of Terms & Website Use

This website is owned and operated by Hexagon Infosoft Solutions Pvt. Ltd. and is protected by copyright and intellectual property laws.

By accessing our website or engaging our software engineering services, you agree to be bound by these Terms of Service and all applicable laws and regulations.

You agree not to copy, reproduce, transmit, or distribute any site materials, software source code, or proprietary media without explicit written authorization.

2. Limitation of Liability

Under no circumstances will Hexagon Infosoft Solutions Pvt. Ltd., its subsidiaries, branches, successors, directors, employees, or partners be liable for any indirect, incidental, special, or consequential damages arising from the use of materials or services provided.

While Hexagon Infosoft takes all necessary precautions to safeguard content and client project documents, we shall not be held liable for loss of data resulting from power failure, hardware/software outages, cyber incidents, or force majeure events beyond reasonable control.

Clients remain responsible for maintaining archival backup copies of all submitted assets and documents.

Service Scope & Liability Boundary

Hexagon Infosoft is responsible strictly for engineering website and application software according to agreed project specifications. Views and content published by clients remain solely client responsibility.

3. Governing Law & Jurisdiction

These Terms of Service are regulated by and construed in accordance with the laws of India.

Any legal disputes, claims, or proceedings arising out of or related to our services shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, India.

4. Replacement & Cancellation Policy

We maintain a structured replacement and cancellation framework to eliminate misunderstandings and ensure project clarity:

Replacement Policy

  • We replace site or software content upon client acceptance; however, structural UI/UX and core codebase rework are not undertaken once milestone approval is given.
  • Content replacement applies if strictly incorrect material was implemented contrary to client submission.

Cancellation Policy

  • Cancellation requests must be formally submitted in writing via email to hello@hexagoninfosoft.com.
  • Cancellation following 20% or more of project completion will be subject to compensation fees for work completed and resource allocation.
  • Cancellation fees are computed strictly based on work executed up to the receipt date of notice.

5. Refund Terms & Adjustments

Applicable cancellation fees will be deducted from any eligible refund. Refunds are non-issuable under any of the following conditions:

  • If full upfront payment was not made at order initiation
  • If cancellation request is received more than 10 calendar days after order placement
  • If a local invoice with VAT / GST has already been issued for accounting

Credit Adjustments

In non-refundable scenarios, remaining unused balances will be converted to service credits applicable against future project orders.

6. Formal Quotations & Orders

Acceptance of a shared quotation or proposal over email constitutes a binding formal order.

The client becomes liable for payment of the agreed estimate even if pricing disagreement is raised at a subsequent stage.

7. Intellectual Property Rights

Hexagon Infosoft Solutions asserts no ownership claims over original intellectual property, documents, or custom business data submitted by clients for project execution.

Clients represent and warrant that they have obtained all requisite copyrights, licenses, and authorizations for third-party media or assets submitted.

Clients agree not to use Hexagon Infosoft services for infringing, defamatory, or unlawful materials.

8. Invoicing & Payment Terms

Invoices are issued by Hexagon Infosoft Solutions upon milestone completion or prior to live deployment.

Invoices are transmitted electronically via email. Payment is due upon receipt. Accounts unpaid after thirty (30) days from invoice date incur late payment interest charges of 1.5% per month.

Additional expenses (e.g., third-party API licenses, premium fonts, stock graphics, paid plugins) required for project completion will be billed separately with prior client approval.
